These Terms of Use (“Terms”) govern your use of autoskelbimai.com and its related services (the “Service”). By creating an account, publishing a listing or otherwise using the Service you agree to these Terms and to our Privacy Policy.

Provider

The Service is provided by Internet Solutions, UAB, company code 302617697, VAT code LT100006088413, registered address Tvenkinių g. 8A-54, Šakių k., Kauno r. sav., LT-47415, Lithuania; correspondence address Vilniaus g. 72-310, LT-76298 Šiauliai, Lithuania; e-mail [email protected] (“we”, “us”).

What the Service is

autoskelbimai.com is a classifieds website for vehicles, machinery and parts. Private persons and companies publish listings, and visitors search and compare them and contact the sellers. The Service also includes a model catalogue, company pages, listing imports for companies, paid listing promotion services and advertising.

We are not a party to any sale or rental transaction. The transaction is concluded directly between the buyer and the seller. We do not sell vehicles, we do not process payments between buyers and sellers, and we do not guarantee the accuracy of listings, the condition of vehicles or the reliability of sellers. Before buying, inspect the vehicle, check its documents and do not pay advance payments to people you do not know.

We continuously improve the Service and may change, add or remove features.

Your account

• An account with a confirmed e-mail address is required to publish listings. You must be at least 16 years old and able to enter into contracts; if you use the Service for a company, you confirm that you may act for it.
• Give correct information and keep your password secure. You are responsible for everything done through your account.
• Creating several accounts to get around restrictions or a block is not allowed.

Listings

• List only vehicles, machinery or parts that you are entitled to sell or rent. Information must be correct, up to date and not misleading: the real price, mileage, year, condition and so on.
• Place the listing in the correct category and give the correct make and model. One vehicle — one listing.
• Photos must show the vehicle being sold, and you must have the right to use them. Photos must not contain other people’s data or unlawful content.
• A listing is valid for the stated period (normally 30 days) and can be extended. When the vehicle is sold, mark the listing as sold or delete it; a listing marked as sold is shown with a “Sold” label for 3 more days.
• By uploading content you give us a non-exclusive, royalty-free right to store, process (for example resize photos) and display it in the Service and in its promotion as needed to provide the Service.
• We may decline to show, hide or reject a listing that breaks these Terms or the law, is in the wrong category or appears fraudulent, and we may restrict or block an account. Where possible we tell you and give the reason.
• New and changed listings are checked automatically for whether they are in the right category and whether the photos match the stated vehicle. If there is a clear mismatch, the listing is temporarily not shown until you correct it or an administrator reviews it; we notify you by email.
• Questions can be asked publicly on listings, and a buyer who has exchanged messages with a seller can leave a review of that seller. Write only truthful information from your own experience: false or offensive reviews, advertising and other people’s personal data are not allowed. The seller can reply publicly. We may hide or delete texts that break the rules. A seller can order a paid service that hides questions, comments and reviews on a listing.

Companies and imports

• A company page is shown publicly after an administrator approves it. We may check company and VAT codes in public registers, including the European Commission’s VAT validation system (VIES).
• When listings are imported from a company’s system or another source, the company is responsible for the accuracy of the data and for the right to publish it. A listing that disappears from the source is no longer shown a few days after the import stops finding it.

Paid services and payments

• Paid services are listing promotions and highlighting for a selected number of days, other listing extras and advertising. The description, duration and price of the service are shown before ordering and apply at the time of the order.
• Prices are in euros. VAT is applied according to the law and shown in the order and on the invoice. Companies from other EU countries with a valid VAT number are invoiced under the reverse charge mechanism (0% VAT).
• You can pay by payment card and other methods shown on the payment page, through PayPal or by bank transfer. Payments are processed by payment service providers; we do not receive or store payment card details.
• The service starts as soon as the payment is received; for bank transfers — when the payment reaches our account. If you tick “VAT invoice required”, the invoice is issued, sent by e-mail and available in your account next to the order.

Purchase terms

• A listing is published after choosing a package (30, 60 or 90 days). The package price depends on the section (sale, rent, parts), the main category and the item price according to the current price list. Prices include VAT.
• A package may include hearts, a highlight and display in the “autoskelbimai.com recommends” block on the home page — their duration is shown in the package. Hearts and highlight can also be ordered separately.
• Hearts lift a listing in its category: listings with more hearts are shown higher, and among equal ones the newer is higher. A highlighted listing stands out with a frame and background.
• A reminder is sent by email before the listing, hearts or highlight expire.
• When the listing expires, it is paused and no longer shown. If it is not renewed within 7 days, the listing is removed together with its photos. Renewal is charged according to the price list valid at that time.
• A promo coupon applies to the package only (not extra services), to one listing and only during the coupon's validity. A “N months free” coupon covers the price of the corresponding package; if a longer package is chosen, the difference is paid. Unused coupon value is not refunded, not transferred to another listing and not exchanged for money — it is lost if the item is sold or the listing is removed earlier.
• The listing must state the real price of the item; listings with an obviously unrealistic price may not be activated.
• The listing text is plain text only: links (URLs) are not allowed, and no more than 3 hashtags (#).

Refunds and right of withdrawal

For refund requests write to [email protected] from the e-mail address registered in your account and give the order number. Each request is handled individually.

If you are a consumer in the European Union, you have the right to withdraw from the contract within 14 days. When you place an order, you ask us to start providing the service immediately. If you withdraw within 14 days, we refund the amount paid minus the value of the service already provided (for example the part of promotion days already used). Once the service has been provided in full, the right of withdrawal no longer applies. This paragraph does not limit any other rights you have under the consumer law of your country.

If a paid service was not provided through our fault, we refund the part not provided. Refunds are made using the same payment method, unless agreed otherwise. If a listing is rejected or an account is blocked for a serious breach of these Terms, fees already paid are not refunded.

Prohibited use

You may not use the Service to:

• break the law or infringe the rights of others, or list stolen vehicles or parts, vehicles without documents or vehicles otherwise sold unlawfully;
• commit fraud, ask for advance payments for non-existent goods, or publish fake or duplicate listings;
• send unsolicited messages or advertising, or collect other users’ contact details;
• copy the Service’s content in bulk by automated means, overload or disrupt the Service or get around its restrictions;
• artificially increase advertising impressions or clicks.

Liability

The Service is provided “as is” and “as available”. We aim to keep it running without interruption but cannot guarantee it. To the maximum extent permitted by law:

• we are not responsible for the content of listings, transactions between users, the condition of vehicles or whether a transaction takes place;
• we are not liable for indirect losses, such as lost profits or lost data;
• our total liability for any claim is limited to the amount you paid us in the 12 months before the event giving rise to the claim.

Nothing in these Terms limits liability that cannot be limited by law (for example for intent or gross negligence) or your mandatory rights as a consumer.

Ending the contract

You can stop using the Service at any time. To delete your account, write to [email protected] from the e-mail address registered in your account; the account is deleted as described in the Privacy Policy. We may end the contract with 30 days’ notice by e-mail, or immediately for serious breaches of these Terms. If we end it without your fault, we refund the unused part of any prepaid period.

Changes to these Terms

We may update these Terms. We will post the new version on this page and inform registered users of important changes by e-mail at least 30 days before they take effect. If you do not agree, you can end the contract before the changes apply.

Governing law and disputes

These Terms are governed by the law of the Republic of Lithuania, and disputes are resolved by the courts of Lithuania. If you are a consumer, you also keep the protection of the mandatory laws of your country of residence. Please contact us first — most issues are solved quickly by e-mail. Consumers may also apply to the State Consumer Rights Protection Authority of Lithuania (Valstybinė vartotojų teisių apsaugos tarnyba, vvtat.lt) for out-of-court dispute resolution.

If any part of these Terms is found invalid, the rest remains in force. These Terms are published in several languages; if the language versions differ, the Lithuanian version applies, unless consumer law requires otherwise.
